Our assessment service can help you determine your likelihood of success in immigrating to Canada. Immigrating to Canada is not simple. There are many elements to the process. The Citizenship and Immigration website, while helpful, is only a guide. The Immigration and Refugee Protection Act is complicated legislation and even the government of Canada states that while their website is a guide, it does not offer legal advice. It is not a legal document.

A brief description of some of the above-mentioned programs that lead to obtaining either Permanent Residence or a Temporary Work Permit include the following:

Skilled Workers & Specialized Labour

One way to enter Canada is via the program for professionals and specialized labour. The person may proceed to apply if their occupation appears on a list of occupations in demand, the person is in Canada on a work permit or has an offer of employment. Some additional requirements of this program are:

  • One-year experience in any of the eligible occupations that appear on the list of occupational demand
  • Post-secondary education
  • Knowledge of English and/or French
  • Meet the required points
  • Optimal age between 21 and 49
  • Applicant’s spouse has post-secondary education
  • Legally worked or studied in Canada
  • Have relatives residing in Canada
  • To be in Canada on a Work Permit
  • To have a job offer from a Canadian company

Business Programs

The Business Immigration Program includes three classes of immigrants and their objectives are to promote economic development and employment across Canada.
The three classes are:

  • Entrepreneurs
  • Self-employed persons
  • Investors

Entrepreneurs

The Entrepreneur is a person who:

  • Has business experience
  • Has a net worth of at least $300.000.00
  • Intends and has the ability to meet the conditions imposed on his/her visa

Self-Employed

The Self-Employed person is someone who:

  • Has relevant experience; and
  • Has the intention and the ability to be self employed in Canada; and
  • Intends to be self-employed in cultural or athletic activities; or
  • Intends to operate a farm
  • There is no minimum net worth required

Investors

The Investor is a person who:

  • Has business experience
  • Has a legally obtained a net worth of at least $800,000.00
  • Will make an investment of $400,000.00 into an approved fund

Family Class Sponsorships

One of the Objectives of Canadian Immigration Law continues to be Family Reunification

Family class sponsorship is available to individuals who wish to sponsor members of their immediate family. Close or immediate family members comprise of parents, grandparents, children under 22 years of age, dependent children over the age of 22 years who are studying, spouses, common law and same-sex partners, orphaned siblings, nephews/nieces and adopted children who are under 18.

A Canadian citizen or Permanent Resident who does not have any member of his/her immediate family mentioned above in Canada may be able to sponsor any family member or relative on a once-in-a-lifetime basis.

  • A spouse or common-law partner and their dependent children may be sponsored from within Canada

Student Permits

Canadian colleges, universities and other educational institutions are open to the world. In order to attend any of these a person must obtain a study permit. International students are allowed to work on campus without the need of a Work Permit. If their grades are good and their study permit is valid for at least six months they can get a Work Permit which allows them to work 20 hours per week. Once a foreign student graduates he/she can apply for and obtain a work permit from one to three years depending on the length of their studies in Canada. With this work experience they may be able to apply for permanent residence under the Canadian Experience Class.

Temporary Work Permits

As a rule, employment in Canada is reserved for Canadian Citizens and Permanent residents. When a Canadian company cannot find a qualified employee within Canada, after obtaining permission from Human Resources, the company may bring a foreign national on a temporary work permit. There are exceptions to this rule. Under the Free Trade Agreements with the United States, Mexico, Chile and Peru there are special programs which allow citizens of those countries to obtain temporary work permits. There are programs for business people and for certain professionals. Some work permits may be obtained within twenty-four hours.

There are numerous other programs such as for software developers, religious workers, athletes, students, spouses of students and workers, artists and many more. They require an offer of employment from a Canadian company. Selecting the program and complying with the program requirements that best works for the individual and the employer is a complicated process.

Quebec Immigration

The province of Quebec offers the same immigration programs as the Federal government, and it is currently actively recruiting new immigrants to fill their specific needs. An important requirement for persons willing to move to Quebec is knowledge of French and an ability to easily integrate into the province’s distinct society. Quebec would be most appealing to people of Southern European descent and to Latin Americans.

Provincial Nominees

In addition to the immigration categories under the Federal and Quebec programs, Canada has entered into bilateral agreements with all of its provinces and territories to allow the provinces and territories to select immigrants in accordance with their specific needs. Each province and territory has its own immigration departments with the objective of attracting immigrants to fill the specific needs of the province. The programs vary from province to province and from territory to territory. The programs are very complex, and the process of matching the immigrant’s profile, the employer’s needs, and the specific programs can be very tricky. Without the guidance of a qualified immigration practitioner, many programs can become a documentary and legislative maze.

Canadian Experience Class (Foreign Workers in Canada)

Certain foreign workers who have worked in Canada for 2 years in a 3-year period may obtain Permanent Residence if they meet the occupational and language requirements.

Some International students who have studied in Canada for at least 2 years and who have worked in Canada for one year may obtain Permanent Residence if they meet the occupational and language requirements.

Citizenship Applications

A permanent resident may obtain Canadian citizenship after residing in Canada for 1095 days in a period of four years preceding their application. If the person obtained permanent residency from within Canada they could obtain citizenship after residing in Canada for two years if they meet all the requirements. Obtaining citizenship provides the person many benefits as well as guaranteeing that the person does not lose his/her status under any circumstance.

Caregiver Program

Individuals willing to provide live-in help to care for children, the infirm or the elderly in the home may benefit form the live-in caregiver program. In order to qualify the person must:

  • Have a Canadian employer
  • Completed the educational equivalent of grade 12
  • Have the ability to communicate in either English or French
  • Have taken a 6-month course in an area related to the work intended or have one-year relevant work experience

Once in Canada, caregivers must work live-in for two years. They will then be permitted to apply for their Permanent Residence

It is important to note that the Canadian government has taken steps to guarantee that workers in this area are treated fairly and in accordance with the labour laws of the provinces.

Refugees

The refugee program allows people who are fleeing persecution to present their case before the competent tribunal to determine if they meet the definition of convention refugee or a person in need of protection. It is imperative that the case be prepared well by a professional knowledgeable in refugee law.

Pre-removal Risk Assessments

Any person who is being removed from Canada has a right to a Pre-Removal Risk Assessment. This is the last evaluation done in order to determine whether or not the person would be at risk if deported from Canada.

Detention Reviews

A person who is detained for immigration violations has a right to a detention review. If the person does not pose a danger to the public and/or to himself; there is no concern that the person would hide from the immigration authorities if released and the person is able to provide proper identification, the person could be released from detention. In most cases the person would require a guarantor.

Immigration Appeals

The appeal division has jurisdiction over specific cases: Refused sponsorships, permanent residents ordered deported, permanent residents who lose their residency because they were out of Canada for more than the time allowed by law and others.

Rehabilitation

Persons who have a criminal record in their country of origin or anywhere in the world are inadmissible to Canada unless they obtain rehabilitation. The rules to obtain rehabilitation vary. Criminal inadmissibility may be overcome by obtaining this document.

Pardons

A person who is not a citizen and was convicted of a crime in Canada will become inadmissible to Canada on criminal grounds. This inadmissibility may be overcome by obtaining a pardon.

Humanitarian & Compassionate Cases

For people who do not fit within any of the programs for immigration to Canada, but find themselves in exceptional circumstances, there is the option of making a request on Humanitarian and Compassionate grounds. An immigration officer may find there are special circumstances that merit a person remain in Canada as a Permanent Resident.

These are brief explanations of programs to show there are a variety of ways to obtain immigration status in Canada.
